Answer: So, that’s a really complicated question that courts have struggled with. It is clear that the Bill of Rights does apply to non-citizens, and specifically states that no person can be denied due process of law and equal protection of the law. However, that does not mean that the Constitution equally applies to non-citizens in all situations, and it is something that the United States Supreme Court has addressed over time in various ways, but there is no single, clear answer that applies in all situations.
