Question: Can habeas corpus petitions be filed at both the federal and state level in Wisconsin? If so, what are the differences?

Answer: For clients with state cases, both state and federal level petitions can be filed. However, clients with state cases can file in federal court only if they exhaust their state remedies. In federal court, a person with a state case files a habeas petition under 28 U.S.C. § 2254.
